The Site is operated by Rich & Richers LLC, doing business as Rich & Richer, from Texas, United States. Our Shipping Policy, Privacy Policy, and Returns and Refund Policy are incorporated into these Terms. You must be able to form a binding contract where you live to make a purchase. If you have not reached the age of legal majority, a parent or legal guardian must supervise your use and make the purchase. You must provide current, accurate information and may not impersonate another person.

You are responsible for activity under your account and for keeping login credentials confidential. Notify us promptly if you suspect unauthorized access. We may suspend or close an account to protect customers, prevent fraud, enforce these Terms, or comply with law.

We try to describe products accurately, but colors and images vary by screen, and manufacturers may change ingredients, flavors, colors, sizes, wrappers, package designs, or production methods. Unless we expressly guarantee a piece count, products sold by weight are measured by net weight and photos or estimated counts are illustrative.

Read the current label before consumption. Product pages and customer-service responses are general information, not medical advice. If you have an allergy, intolerance, dietary restriction, medical condition, or question about suitability, consult an appropriate professional and contact us before ordering. We do not guarantee an allergen-free environment or a dietary certification unless we expressly state it for the specific product.

Your order is an offer to buy. An automated confirmation acknowledges receipt but does not mean we have accepted the order. We accept an order when we begin fulfillment or send a shipping confirmation, whichever occurs first. We may limit quantities or refuse or cancel an order for product unavailability, suspected fraud, payment failure, address or legal restrictions, pricing or description errors, reseller activity, or another lawful reason.

If we cancel an item after payment, we will refund the canceled amount. If only part of an order is unavailable, we may ship the available items and refund the unavailable part, or contact you for instructions. We do not intentionally make a materially different substitution without permission.

Site prices are stated in U.S. dollars unless checkout clearly says otherwise. Prices, availability, and promotions may change before an order is submitted. Applicable sales tax, shipping, duties, and other charges are shown or calculated at checkout when possible. You authorize us and our payment providers to charge the amount shown at checkout.

We may correct a typographical, pricing, discount, or product-description error and cancel an affected order, even after confirmation, when permitted by law. If the correct price is higher, we will not charge the higher price without your approval.

A promotion may have separate dates, eligibility, product exclusions, purchase minimums, quantity limits, or redemption rules. Unless we say otherwise, promotions cannot be combined, have no cash value, and must be applied before payment. We may cancel or modify a promotion because of fraud, error, legal requirements, or circumstances that prevent it from operating as intended. Gift cards and credits are governed by the terms shown when issued and applicable law.

Review custom-mix selections, quantities, names, messages, colors, and delivery details before submitting an order. The order becomes final once picking or preparation begins. We may refuse content or instructions that are unlawful, infringing, hateful, threatening, deceptive, or technically impracticable. Availability can affect the precise proportion of pieces in a mix, but we will not intentionally substitute a materially different candy without permission.

Processing dates and delivery dates are estimates unless we expressly sell a guaranteed service. The Shipping Policy explains destinations, address responsibilities, tracking, delays, weather risks, customs, lost packages, and damage claims. The Returns and Refund Policy explains final-sale food products, claim deadlines, eligible problems, and remedies. Those policies form part of these Terms.

We grant you a limited, revocable, nonexclusive, nontransferable right to use the Site for personal shopping and other lawful purposes. You may not copy, scrape, frame, reverse engineer, disrupt, overload, or exploit the Site; bypass security or access controls; use automated tools without permission; introduce malware; collect another person's information; commit fraud; infringe rights; or use the Site for unlawful or abusive activity.

The Site and its original text, graphics, photographs, videos, logos, product arrangements, software, and design are owned by or licensed to Rich & Richers and are protected by intellectual-property laws. Third-party brand names and product images belong to their respective owners. These Terms do not transfer ownership or grant a trademark license.

If you submit a review, photo, video, recipe, idea, or other public-facing content, you keep any ownership you already have. You give Rich & Richers a nonexclusive, worldwide, royalty-free license to host, reproduce, edit for length or format, display, and use that content to operate and promote our business. This license does not apply to private payment details or customer-service communications that are not intended for publication.

You promise that you have the rights and permissions needed to submit the content and that it is accurate, lawful, and does not violate another person's rights. We may remove or decline content, but we are not required to monitor every submission.

The Site may link to or use services operated by payment providers, carriers, marketplaces, social platforms, or other third parties. We do not control their content, availability, security, or privacy practices. Your use of a third-party service is governed by its own terms. A link does not mean we endorse every statement or product on the linked service.

To the fullest extent permitted by law, the Site is provided on an “as available” basis. We do not promise that the Site will always be uninterrupted, error-free, or secure, or that every description or image will be free from minor errors. This disclaimer does not override an express written promise, a manufacturer warranty that applies to you, or a consumer right that cannot be waived.

To the fullest extent permitted by law, Rich & Richers and its owners, employees, and service providers will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from Site use or an order. For a claim involving a direct Site order, our aggregate liability will not exceed the amount paid for the affected order.

These limits do not apply where the law forbids them, including certain claims involving fraud, willful misconduct, personal injury, defective products, or statutory consumer rights. Some states do not allow particular exclusions, so a limit may not apply to you.

To the extent permitted by law, you agree to reimburse Rich & Richers for reasonable losses, liabilities, and costs arising from your unlawful misuse of the Site, material violation of these Terms, or content you submit that infringes another person's rights. This section does not require you to cover losses caused by our own unlawful conduct.

We are not responsible for a delay or failure caused by events beyond our reasonable control, such as severe weather, natural disaster, carrier disruption, labor action, war, terrorism, public-health emergency, utility or internet outage, government action, or supply interruption. We will still provide any delay notice, cancellation option, or refund required by law.

Before filing a formal claim, contact us and give us a reasonable opportunity to resolve the issue. These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any court proceeding must be brought in a court of competent jurisdiction in Texas, except when applicable consumer law gives you the right to proceed elsewhere. Nothing in these Terms prevents either party from using an eligible small-claims court or reporting a concern to a government agency.

We may update these Terms by posting a revised version with a new last-updated date. Changes apply prospectively from the effective date, unless the law requires otherwise. We may suspend or end access to the Site for a material violation, security risk, fraud, or legal requirement. Provisions that logically should continue after termination remain in effect.

If a court finds part of these Terms unenforceable, the remaining parts remain effective and the invalid part will be limited to the minimum extent necessary. A delay in enforcing a right is not a waiver. You may not assign your rights or obligations without our written consent; we may assign ours as part of a merger, reorganization, financing, or sale of the business. These Terms and the incorporated policies are the entire agreement about the Site and direct Site purchases, except for any additional written terms that apply to a specific product or promotion.
